How Your Home Is Marketed
Updated November 3, 2026 · Milton Coste, Licensed Real Estate Associate Broker · Keller Williams NYC
You decide who sees your home and when. This form lays out the four options New York City listing rules allow, what each one gives up, and records the path you choose. It travels with your listing agreement.
| Option | Who sees it | Showings | Days on market |
|---|---|---|---|
| ALive right away (Active) The most buyers and agents see your home from the first day. |
Everyone: the RLS, broker websites, StreetEasy, Zillow, Trulia, social media and email. | Yes, and open houses. | Count from day one. |
| BPublic preview first (RLS Coming Soon + StreetEasy Preview) Ads must say "Coming Soon. No Showings or Open House until [date]." |
The public, with the go-live date shown. Up to 14 days. | None. No open houses and no negotiations until the go-live date. | Do not count. |
| CAgents-only preview (RLS Participant Only) Buyers without an agent who checks the RLS will not see it. |
Agents at RLS member firms, in their listing software. No public websites, social media, mass email or automated alerts. | Yes, private showings arranged one-to-one. | Do not count. |
| DOwner opt out (not shared through the RLS) The narrowest audience of the four. Needs the REBNY Owner Opt-Out form. |
Only agents and buyers contacted one-to-one. | Yes, private showings arranged one-to-one. | Do not count. |
What less public marketing can cost you
Choosing options B, C or D for any period means:
- Reduced visibility to buyers and to agents outside the firms that see it.
- Limited online exposure: listing websites, syndicated feeds, email blasts, newsletters and social media may not show it.
- Possibly fewer offers, which can affect your price and how long the sale takes.
- Fair housing laws apply to every form of marketing. No buyer can be excluded or favored because of a protected characteristic.
Rules that come with each option
- Coming Soon lasts at most 14 days, then the listing goes live, is taken off the market or is withdrawn. It can be used once per owner unless the home has been off the market at least 60 days. It applies to sales only.
- Coming Soon needs the REBNY Coming Soon Owner Authorization. Owner Opt Out needs the REBNY Owner Opt-Out form, uploaded to the RLS within 48 hours of signing the listing agreement, on the current version, with the full address and unit number and every owner's name, signature and date. This form does not replace either one.
- Any public marketing requires the listing to be in the RLS at the same time. Agents-only and opt-out listings can be shared only one-to-one, never by mass email or automated alerts.
- Your listing is never described as "off-market" in any listing text.
New York State law
New York lawmakers passed Assembly Bill A10679 in June 2026. It would require a standard state disclosure before a seller chooses less public marketing. As of November 3, 2026 it has not been signed. If it becomes law, the state form will be added to this one.
